These Terms of Use ("Terms") are an agreement between you and Nandha Kumar Ilangovan ("the Developer", "we", "us", or "our") for the use of the So Alarmed app ("the App"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, please do not use the App.
Please also read our Privacy Policy, which explains how we handle your information.
You must be at least 13 years old, or the minimum age required in your country, to use the App. By using it you confirm that you meet this requirement and that you are able to enter into these Terms. If you use the App on behalf of someone else, you confirm that you are allowed to accept these Terms for them.
We grant you a personal, limited, non-exclusive, non-transferable, and revocable license to download and use one copy of the App on Apple devices that you own or control, for your own personal and non-commercial use, in line with these Terms and the App Store Terms of Service. We keep all rights that we do not expressly grant you.
Please read this section carefully, because it matters.
So Alarmed is a convenience tool. We cannot and do not guarantee that an alarm will always sound, sound on time, or wake you. Whether an alarm works depends on many things outside our control, including your device's volume, your silent or Focus settings, the battery level, available storage, software updates, the version of iOS, whether the App or device was restarted, and how your device manages background activity.
Do not rely on So Alarmed as your only way to wake up for anything important or safety-critical, such as catching a flight, taking medication, getting to work, or any situation where missing the alarm could cause harm, loss, or injury. We strongly recommend that you keep a backup alarm. To the fullest extent allowed by law, we are not responsible for any loss or harm that results from a missed, delayed, or silent alarm.
The wake-up missions, including math, typing, memory, shake, walk, and maze, are meant to help you wake up. They are not medical or health products.
The App offers an optional paid subscription that unlocks premium features. Some features require an active subscription or trial.
You can use the App without an account. If you choose to sign in with Apple or Google to back up your data, you are responsible for keeping access to your sign-in method secure. You can delete your account at any time in the App, under Settings then Delete account, which removes your backed-up data as described in our Privacy Policy.
You agree not to:
The App, including its design, text, graphics, sounds, and software, is owned by the Developer or its licensors, and is protected by intellectual property laws. These Terms do not transfer any ownership to you. So Alarmed and its logos are marks of the Developer. Apple, the Apple logo, and related marks belong to Apple Inc. Google and related marks belong to Google LLC.
The App relies on third-party services to work, including Apple (App Store, StoreKit, Sign in with Apple, AlarmKit), Google Sign-In, and Google Firebase (Authentication and Cloud Firestore). Your use of those services may also be governed by their own terms and privacy policies. We are not responsible for third-party services, and listing them here is not an endorsement.
The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure, or that it will always work as described, including the timely delivery of alarms (see Section 3). You use the App at your own risk, to the extent allowed by law.
To the fullest extent allowed by law, the Developer will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, sleep, missed events, or other intangible losses, arising from or related to your use of, or inability to use, the App, including any missed or delayed alarm. To the fullest extent allowed by law, our total liability for any claim relating to the App will not be more than the greater of the amount you paid us in the 12 months before the claim, or five US dollars.
Some places do not allow certain limitations, so parts of the above may not apply to you. Nothing in these Terms limits any rights you have that cannot be limited by law.
To the extent allowed by law, you agree to cover and hold the Developer harmless from any claims, losses, or expenses, including reasonable legal fees, that arise from your misuse of the App or your breach of these Terms.
These Terms apply for as long as you use the App. We may suspend or end your access to the App or its paid features if you break these Terms. You can end these Terms at any time by deleting the App. Sections that by their nature should continue, including intellectual property, disclaimers, limitation of liability, and governing law, will keep applying after termination.
We may update these Terms from time to time. When we do, we will change the "Last updated" date at the top of this page, and for important changes we will give notice inside the App where it makes sense. If you keep using the App after an update, that means you accept the updated Terms.
These Terms are governed by the laws of India, without regard to its conflict-of-laws rules, except where local consumer-protection law gives you rights that cannot be waived.
Because the App is distributed through the Apple App Store, the following terms apply to your use of the App. Apple refers to these as the minimum terms for a Licensed Application End User License Agreement.
